Essay on Epic Poetry

Essay on Epic Poetry

An epic poem has a universal appeal and there are many factors that make it that way. One such universal appeal the epic poem Beowolf has are the traits that were admired back in the Anglo-Saxon period when it was passed down as an oral tradition. Two other such factors that make it an epic poem are the lofty language used, and the supernatural element given to the story.

One such factor that makes Beowolf an epic was how it exemplified the traits that were admired. A trait that was well respected by the people in the time of Beowolf were the leadership abilities of the leader. An example of this can be found on lines 450 to 467 in which it states, "Hrothgar, Oh knowing king, now when my danger is near, the warm words we uttered, and if your enemy should end my life then be, oh generous prince, forever the father and protector of all whom I leave behind me". In those lines Beowolf exemplifies his leadership abilities by asking Hrothgar to look after his men if he should fall. This trait was very admirable in the times of the Anglo-Saxon people, and can still be related to today.

__________________________________________________________

Another such detail in an epic poem is the lofty language that is used. This lofty language is used to create a more dramatic affect in the story as it is being told. One such example of this can be found on lines 461 to 462, where it calls the king "a giver of rings". Lines such as this make a story a true epic as it heightens the language and dramatic effects of the story.

Lastly, one other detail that classifies Beowolf as an epic is the supernatural element given to the story. One event in the poem that can be classified as supernatural can be found on line 530 to 533 which states, "The he saw, hanging on the wall, a heavy sword, hammered by giants, strong and blessed with their magic, the best of all weapons". In these brief lines it states how giants have made a sword and blessed it with their magic. This element of the story helps classify Beowolf as an epic in that it exemplified many of the beliefs held to that day. It also helps it survive the test of time by adding a more exciting feel to the story.

As one can see Beowolf can easily be classified as an epic. It is seen as such because it includes many elements of an epic. These elements include the admired traits of the time, the lofty language used, and the supernatural effect given to the story. Beowolf can also be seen as a great epic as it has survived the test of time, and will survive for generations to come.

Health Care System Evolution Essay

Health Care System Evolution Essay

In this paper I will investigate in Managed care evolution, and its importance in relation to the overall Health Care reform, as well as present and analyze changes that experienced managed care.

In order to evaluate the influence of Managed Care, it is necessary to follow all stages of its development, starting with its emergence, estimate its consequences, key parameters, understand all advantages and disadvantages not only from the standpoint of the client companies, but also for counselors who are working in Managed Care Organizations.
_________________________________________________________

__________________________________________________________

Managed care as the separate service emerged in the beginning of 1990s and had a great impact upon counseling and psychotherapy practices. The great problem at the very beginning was that there were almost no books for beginners and the new staff lacked professionalism. The main reason for establishing managed care was the need in cutting costs for medical treatment, and managed care succeeded in fulfilling this particular task, although the situation was temporary. Consequences of cost reductions were rough, as managed care organization reduced costs not by means of increasing efficiency of services provided, but by decreasing number of clients and decreasing funding of service providers. Managed care brought a lot of new rules and regulations that seemed like another language to counseling professionals, and although they were knowledgeable in their spheres, they had to start learning again in order be able to co-exit with this new type of health care.

There was a conflict between providing best care services at lower costs, as better range of care services, the higher are the prices.

Prices for medical services at the beginning of the 90s were constantly increasing. There were few reasons for that, which included: increases of inflation rates and increases of the costs for the mental health. Lack of professionals in definite spheres also affected the decrease. Some other reasons included: more services were used by the elder people and aging population, improved medical technologies needed more funding; a lot of money were spent on administrative and supportive staff (Altman, 1999).

At the same time federal government started the process of industrialization of health care system in USA. Creation of centralized and structures managed care was inevitable. Even though managed care organization emerged in the beginning of the twentieth century (Western Clinic in Tacoma, 1910, Farmers’ cooperative Health Plan in Oklahoma, 1929 and Kaiser Foundation Health Plans, 1937), the real necessity in them appeared only during last two decades (Dranove, 2000). There were offered three basic stages of behavioral managed care development. The first stage can be characterized by shifting of traditional health insurers (for example, of Blue Cross) to Health Managed Organizations. Their goal was increasing savings and revenues. So, now they focused more upon gaining profit and not providing qualified medical help. These goals were achieved by means of cutting access to particular services (providing only one program out of several that can be four hours by car away).

The second stage was about focus upon large employers, making them the target market. Behavioral health was strongly encouraged to be separated from other medical services. Means were very different for achieving this- from publicity to personal persuasion. Large companies, in their turn, demanded cost control, discounts, and minimum complaints from the side of patients.

The last stage was characterized with the consolidation of the managed care organizations, with the disappearance of traditional insurers from the market and drastic increase in number of licensed professionals who were willing to work, and subsequent decrease in their income.

The first and the most important challenge of managed care became lack of adequate health care. Results of the conducted research showed that people were not satisfied with the provided services, haven’t received in-time services or had problems regarding paying for services. The limited number of providers’ strategy that was originally used to save costs, resulted in bad treatment services, and showed no improvements. When the company that should have taken care of people’s health, transfers to the mission of gaining more, then there is nothing to say about what kind of service they would provide. And even though such a switch was an obligatory measure stipulated by the lack of state funding, quality should also be pursued in any case. There was the change in the types of services offered. The psychotherapy and psychological testing became less profound and complicates by switching to more brief therapy, crisis intervention, medication and substance abuse treatment. The level of specialists also decreased from doctoral levels to common nurses, psychiatrists and bachelor-level specialists.

Simultaneously with all stated consequences, the amount of paper work increased as well as administrative expenses, as the number of administrative staff was greatly decreased, effectiveness of work in this sphere decreased greatly. Practicing doctors were wasting lot of time for administrative work and performed less of their direct job tasks. Another problem with paper work was for the client companies and providers connected with constantly changing rules, regulations and forms. Training opportunities were also very restricted, because of lack of financial resources. Students, who were willing to practice their skills, not payment for their ob was offered for the reason that they were not licensed yet. So, students had problems in acquiring enough clients during their practice. Training problems finally resulted in decreased ability to ensure training upon long-term basis mental health, and switching to short-term, as well as in additional stress for staff in viewing students as additional burden to their every-day responsibilities.

Managed care companies in general are not willing to change their way to do business. And then the question arises upon whether the basic care that they provide is good or bad. In order to answer it objectively, it is necessary to understand to whom good or bad. For client companies (who take care of its employees), patients (who just want to be health and happy) and government (that has to protect rights of its citizens) - it is bad, for managed care companies, which are looking for cutting expenses and gaining more profit, it is good. And the task is to find the best solution, which would benefit both sides, as health care crisis is the stumbling block of ethical standards and human rights.

In the conclusion, I would like to presentseveral suggestions to improve quality of managed care services delivery, which are primarily connected with establishment of democratic allocation procedures, fair grievance procedures and also practicing more respect for privacy and confidentiality. And there were developed nine directions that would improve activities of managed care organizations. The first one is about continuing transition from inpatient to outpatient services, as this step would reduce costs for providing mental health services, as there is little evidence that inpatient treatment is more effective then outpatient and costs for providing outpatient services are much less. The second hint refers simplifying managed care and medical bureaucracy- less administrative work- less expenses. The third advice concerns constant investments in the research. Even though such investments are long-term ones and will not be paid back immediately, they are essential driving part of contemporary managed care. The forth hint concerned removing control of health insurance from employers. The fifth advice is about having enough supportive staff at the managed care companies, so that each staff member was doing his or her particular job, there were no overlapping job responsibilities and no staff deficit. Traditional labor strategies are also firmly advised to be considered as well as offering managed care to the educational programs and giving students the opportunity to receive practical experience. Managed care professionals should be politically active and participate actively in lobbing laws and regulations about managed care. And finally counseling professionals should stay informed about all changed occurred not only in their organization, but also from outside (professional newspapers, journals, web-sites, etc.). It is very helpful to share own experiences, successes and problems with other specialists and to hear their opinions, acknowledging something new and constantly improving professional skills.

Existentialism and Perspectivism Essay

Existentialism and Perspectivism Essay

When an average person on the street is asked what the truth is he/she would probably say that truth is a concept that is different for everyone. This answer would be totally correct, because we, the modern humans, could never define what truth was if even such great philosophers as Nietzsche and Sartre had different opinions on this matter. Moreover, the mentioned above philosophers as well as other wise men always found it complex to come to an accord when discussing philosophical matters. In my short essay I would like to give a short insight into two philosophical streams that are Existentialism and Perspectivism as well as compare their outlook on the concept of “truth”.
_________________________________________________________

__________________________________________________________

To begin with I would like to briefly describe Existentialism. It is a philosophical movement that places the main emphasis on the existence of a human being. Existentialism calls attention to freedom of action and freedom of choice. According to this movement one is always free to act in any way he/she wills. In addition, one should not consider the feelings of others on the way of perusing this freedom, because every person is considered to be alone in the world and is not expected to give consideration to those around him. Such attitudes are well described in books by Sartre and Camus (Craig, 18).

When it comes to defining truth, Existentialism has couple of points. To begin with, “truth” is defined by a man individually. It is considered that to view the world is already the truth. This is because in Existentialism truth is something that is based on facts and not on emotions. Though, the truth can be used in a good way or bad way, so to say acting in good or bad faith. Thus, in the concept of truth it is once again pointed out that every individual has a freedom of choice. It is interesting that Existentialism considers an act to be good and something to be true if it is performed in a way that the entire human race would be represented. This seems to be enough to attest an act as a moral one (Craig, 15).

The next philosophy I would like to discuss is Perspectivism. The main idea of Perspectivism is that there are many different perspectives, so to say many conceptual schemes of every concept and action. Every human being possesses the ability of looking at the world with different perspectives and he/she is adopting one of these perspectives depending on the situation. The way one looks at the world and its happenings is the way he/she resolves his/her judgment and understanding of truth (Craig, 535). This means that all the ways of looking at the world have a right to exist and not only that, but also no perspective is more correct or sane than its rival. It this way it can be said that Perspectivism is alike with Relativism that also considered that all the things and opinions are relative and may be looked at from different perspectives, though these philosophies are rather different (Craig, 534).

From the philosophies discussed above it can be seen that the concept of “truth” tends to be rather unclear. Existentialism and Perspectivism are two very different streams in philosophy, though the way these streams look at “truth” are a little similar. Existentialism considers truth to be everything a person sees around, Perspectivism allows many sides of an object or action to be true. Therefore, both of these streams, when defining truth, leave freedom of choice and do not limit it by strict criteria.

Crisis Management Research Paper

Crisis Management Research Paper

Description of the company and the problem
Enron was one of the leading companies operating in the energy market of the US. The company was traditionally viewed as one of the industry’s leaders and investors believed the company was quite reliable. However, the reliability of the company was questioned when former officials of the company said Enron hid its gains during crisis in California. In fact, such accusations provoked serious suspicions among investors and clients of the company because the hiding of the company’s gains during the crisis in California cannot be interpreted otherwise as the deception of investors and clients of the company. In this respect, it should be said that the crisis in California was closely intertwined with the growing energy costs and companies consuming energy had to pay high price to companies producing the energy. In other words, they should pay to Enron which occupied the leading position in the energy market. In such a situation, the fact of hiding gains of Enron was of the paramount importance because, in case the true gains of the company were known to the public and investors, the company was likely to be forced to reduce prices in order to ease the tension in the energy market. This step would facilitate overcoming crisis and prevented companies from considerable financial losses provoked by high energy prices established by Enron. Therefore, the uncovering made by former executives of Enron put the company into a disadvantageous position because it undermined the positive image of the company and, what is more, Enron became a subject of a particular attention from the part of regulatory agencies.

Memorandum
To workers of Enron
The current situation in the company remains stable though the rumors concerning our company and spread by mass media disturb you. Naturally, the negative image of the company which our former executives have created due to their fancied allegations of Enron, which presumably had hidden its gains during the California crisis, have nothing in common with reality. I am sure you know as well as I do that fairness is our major principle and we have never deceived neither our customers, nor our business partners, nor, what is more, our employees who are the main value of our company.

At the same time, the fact actions of our former executives cannot be justified. In fact, they are a disgrace for our company. These former executives have already proved their inability to manage effective and you, employees, have suffered a lot from their ineffective management. So, I believe you are not surprised with their fraudulent allegations. I am also sure that you feel the changes for better in our company and you know that we never hide any information neither from you nor from the public. This is why I would like you to continue you work and do not worry about the future of our company and your own future. I am sure it is perfect. So you can be certain in your future and you can inform the mass media that our company did not have and does not have any troubles.

Letter
Dear Mrs., Mss.
I am writing to inform you about recent events and rumors that affect the performance and public image of our company consistently. In fact, the entire matter is apparently misrepresented in the media which lack the objective and reliable information on the policy of our company and our actions during the recent crisis in California. Naturally, it is just a misinterpretation provoked by allegations of our former executives who informed the media and the public about our company hiding its gains during the crisis in California.

I would like to clarify the situation in order to avoid erroneous suspicions and further allegation of our company. Our company has always been open to the public eye and we will readily provide you with all the information concerning our policies and our actions during the California crisis but I would like to assure you that we did not violate any legal norms and all our actions were absolutely correct. Moreover, I should say that our company had suffered a lot from the recent crisis and our losses are quite substantial, though they do not threat to our marketing position.

Finally, I would like to underline that the allegations of our former executives are not grounded on real facts. In stark contrast, they are absolutely fake and provoked by the irresistible desire of our former executives to revenge on our company as they had lost justly their job.

To clarify the situation and our position I invite you to speak to our marketing department which will give you ample information on our actions and policies during the California crisis.

E-Mail
Dear partner,
I am sorry to disturb you during your vocations, but recent events force me to inform you about recent troubles which affected our company dramatically. I am not sure whether you heard about our former executives who informed the public about our presumable hiding gains during the California crisis. I am convinced that you would perceive this information as absolute nonsense. As you know we always provide the public and, above all, our partners with the precise information on our position and our gains. Moreover, in the course of our long-lasting partnership you had already learned that we had never admitted the possibility of fraud in relations with our business partners, investors or customers.

In fact, we share the same values as you do and we are unable to take immoral or, what is more, illegal decisions. I home that this stir in the media which began because of our former executives will soon stop because their allegations are ungrounded. As you know we performed well during the crisis but we remained fair. Moreover, we had hardly escaped crisis ourselves because of the poor management from the part of our former executives who are know accusing our company of hiding gains.

Thus, I would like to reassure you that our current position remains unchangeable, we are still performing well and there are no real threats to our partnership.

Hope you enjoy your vacation and our troubles will not affect you in any way.

SMS
Dear Customer,
Our company is sorry for the recent rumors that accompany Enron. I hope they did not change your attitude to our company and you will continue to use our services. In all probability, you have already heard about recent allegations of our company for our former executives said we were hiding our gains during the California crisis. It is a shame for our company to employ such executives because they are lying about our actions during the crisis. In addition, you should be aware of the fact that media had little information about the actual situation and actions of our company. In fact, they represented the version of our former executives only, while they totally ignored the position of our company. Soon, we will inform the media about the actual actions of our company during the California crisis.

However, before we would like to inform you that we had never undertake any unethical or illegal actions and we had always been open to the public and our fairness, especially in relation to our loyal customers, proves to be beyond a doubt. I hope you would not have troubles because of these unsubstantial rumors and we will keep working together. I hope you understand that we have just temporary difficulties with our former executives who just want to revenge on our company after the loss of the job.

“Hum Aapke Hain Kaun” Essay

Family and Kinship in “Hum Aapke Hain Kaun”

This paper, by referring to the concrete settings and events portrayed in Hum Aapke Hain Kaun, analyzes how family and kinship relationships are made the central theme in this film.

A number of Indian romance films of the 90’s center on and renegotiate the couple’s relationship with the family. Sooraj Barjatya’s Hum Aapke Hain Kaun (Who Am I to You, 1994) softens the blow against patriarchy. The narrative axis shifts, escapes the issue of individualism, and wrestles instead with new arrangements within the family (John and Nair, 35).
_________________________________________________________

__________________________________________________________

In Hum Aapke Hain Kaun, two long-lost friends meet when their children are grown and negotiate a marriage between them. Pooja (Renuka Sahane) and Nisha (Madhuri Dixit) are the daughters of a professor (Anupam Kher) and his wife (Reema Lagoo). Pooja marries their old family friend’s (Alok Nath) adopted son, Rajesh (Monish Behl). During the protracted North Indian wedding celebration which dominates the film, the groom’s younger brother, Prem (Salman Khan), falls in love with the bride’s sister, Nisha. Meanwhile, Pooja’s father-in-law entrusts her with finding a marriage alliance for Prem, prompting Nisha and Prem to confide in her. Pooja dies suddenly before sharing this information with anyone (Sooraj Barjatya, Hum Aapke Hain Kaun).

The family elders suggest that Rajesh, a young widower now with an infant, remarry. They propose the infant’s aunt, Nisha, as the appropriate match. Rajesh agrees that Nisha accepts the proposition. Nisha does—assuming the proposal is from Prem—only to later discover the mix-up. For the baby nephew’s sake, a guilt-ridden Nisha goes along with the betrothal despite her unhappiness. On the wedding day Rajesh miraculously intercepts a letter Nisha writes to Prem and learns of their relationship. Rajesh announces Prem’s marriage to Nisha in place of himself moments before the wedding ceremony (Sooraj Barjatya, Hum Aapke Hain Kaun).

In Hum Aapke Hain Kaun, the romance is not set in the traditional holiday resort, but in large homes in which lovers maneuver to maintain their privacy, keep the relationship a secret, and gain relative autonomy from parental figures (John and Nair, 35). The secret is shared between the couple and their peer group within the audience. Complications arise because the family elders fail to discover the romance. In earlier films secrecy was ensured by the anonymity of the location where the boy and girl met coincidentally. They promise secular possibilities: individuals imaginative by their caste and clan origins fall in love. In the conservative romance films anonymity is displaced by family connections. Within the family a thin line separates privacy from secrecy, which relies on an unspoken assumption much like “Don’t ask, don’t tell.” (Lewis, 137)

Perhaps part of the viewing pleasure lies in seeing how the couple forges a private space for themselves by, for instance, exchanging surreptitious glances. In Hum Aapke the couple express their desires in the midst of revelry—occasioned by an engagement, wedding, or the birth of a child. The protracted wedding celebration maximizes the pleasure in ritualized articulations of filial and sexual tensions through folk songs, dance routines, and romance sessions (John and Nair, 35). These moments of revelry are occasions to celebrate its own musical tradition. Embraced by all classes and communities, this music is truly the emblem of national popular culture.

In Hum Aapke a prolonged song-and-dance sequence in a strictly demarcated women’s space marks the celebration of Pooja’s first child. In the all-women’s gathering a woman in drag (dresses identical to the male lead) pairs with the leading lady, Nisha, playing an oversized pregnant woman. Together they parody “private scenes” between heterosexual couples, regaling everyone (John and Nair, 36). The lead male star and his buddies are voyeurs, gazing at the performance meant for women only—the woman in drag enacting scenes a man could never perform publicly with his lady love. This strategy serves a dual purpose. It recreates women’s space where women traditionally relax together, enact heterosexual encounters, act as sexual teases, and mock men and the codes of intimacy (John and Nair, 35).

The loss of “women’s space” in the midst of rapid urban modernization has meant a collective forgetting of traditional folk songs and customs (Lewis, 136). The extended sequence in Hum Aapke celebrating family and kinship relationships functions as the discovery sign of the new millennium.

Stem Cell Research Essay

The Guidelines and Social Responsibility of Stem Cell Research

Stem cells are said to be variable cells in the body of the human-being that are capable to reproduce themselves and to produce more cells. They possess big potential value in regenerating and repairing of cells and tissue, which were damaged. Nowadays many states can be currently or potentially treated with the stem cells introduction, that include heart disease, Parkinson’s, Alzheimer’s, stroke and diabetes.

Stem cells can be derived from different sources. They can be derived from the foetus or older human embryo, from the early human embryo, from the newborn baby (for instance, from the umbilical cord), from the adult and from the child. Simultaneously with the development of the individual, stem cells become more connected to the definite destination in the body, but there is still space for some degree of flexibility.
_________________________________________________________

__________________________________________________________

Embryonic stem cells are derived from the human embryo after a miscarriage, or during or after an abortion. They can also be derived from the early human embryo after in vitro fertilization (IVF) or after procedures that are similar to it. The IVF embryo may be `reserve’, for example in case of excess to the infertile couple’s demands. As the alternative, the embryo may be specially created for experimental use.

In the near future embryos may be prepared for experimental use by means of cloning. In this process, unfertilized ovum nucleus is substituted by the body cell nucleus from an existing individual. The ovum is after stimulated to produce an embryo. As the nucleus includes approximately all genetic material of the cell, the embryo produced is the clone of the individual from which the nucleus was taken, and could be used as a stem cells source for research and transplantation in the long run.

Sometimes cloning for research is viewed as therapeutic that is opposite to reproductive cloning. During reproductive cloning, the clone is placed to the woman’s body and allowed to mature. It should be also remembered that the cloning process by itself is the same as therapeutic and reproductive cloning: the only distinction is in the purpose for which the clone is supposed to be produced.

The notions `therapeutic’ and `reproductive’ in this situation are not fully correct, as `therapeutic’ cloning is not actually therapeutic for the clone, which is going to die in the course of its cells being taken away when at the age of 5-7 days. It is possible to claim even more, as such cloning is said to be reproductive, because it implies the embryo production, even though this embryo is not supposed to live to the point of being born. Cloning followers admit that the clone embryo is a living human organism at the early stage of its development.

Law and morality are anxious with the respect that is due to human beings as moral issues. People can not be diminished to the amount of their physical parts or their biological behaviors. Competent and mature human beings are able to make decisions for themselves, for which they are supposed to be responsible both legally and morally. In fact, all human beings are members of the human community, and it doesn’t matter whether they are mature enough, as they all share the common humanity.

Human beings are not to be considered just primitive physical objects or animals, as they all have a common merit and significance. But still it is essential to point out that human beings are animals of the definite sort. People are not supposed to consider the real individual as a spirit in his head (or simple consciousness and mind) or a spiritual something that is using a body, as human body is one thing and the personality of the person is totally different.

The Greeks spoke of the human being as of the rational animal and this appears to capture something of a human being true essence, but the term rational should not be defined in too narrow meaning. In the same manner the philosopher Boethius provided the definition of the subject as an individual being which has a rational nature: persona est rationalis naturae individua substantia. Provided definitions have the big advantages of recognizing the transcendence and unity of the human being. The human individual is not just two notions bound together, physical body and spiritual constituent, but one complete being.

Human rights are to be respected by other people and protected by society. Though every separately taken definite human society is looking to restrict those who can be considered to be full members of the society, there is a definite minimum protection that is in general thought due to each human individual, whether he is considered the full citizen or not. Speaking about human rights and social responsibility, it must be taken into consideration that there should have been the universal kind of community to which all human individuals would belong and each individual would have the human rights for the simple reason that he is the human-being.

It is not the situation that embryonic stem cell research provides a real chance in the near future of revolutionary therapy for the serious deceases treatment. It is not also the situation that there are no other promising variants of research. The early embryonic cells pluripotency that is the reason they are considered to be attractive to researchers, is simultaneously the biggest barrier for their involvement. These cells flexibility makes them vagarious in the kinds of cells they create, so that they can be even dangerous for the patient if they used in transplants.

Adult stem cell research is the great promise in this area. Utilization of adult stem cells offers no ethical dilemma and, if personal cells of the patient are utilized, eludes rejection problem. Such treatment, which is already in the development process, is acceptable to the vast majority of patients from the moral standpoint. In the necessary cases, embryonic stem cell research can be made in ethically acceptable ways, on animal embryos cells or, with the parents’ approval, from foetuses who have miscarried.

Scientists are not willing to be restricted in the methods they use in their research, but social responsibility frequently makes legal limits, which appear to be essential and right in the definite case.

There are ethical possibilities which propose better or a least similar instant or/and long term potential solutions, and the government should provide strong review to the moral doubts which have been conveyed and the public concern around the situation of the involvement of embryos for research, and which is even more important- the licensing of human cloning for purposes of research. Stem cell research on clone has been made legal when research adult stem cell is the most progressive.
Cloning prohibition was recommended by the European Parliament, which covered cloning for research along with cloning for birth. It is obvious that if cloning for research is allowed, cloning for birth will be also possible.

Acceptance of cloning for research would also make unavoidable further research on human embryos extensions that are older than 14 days. There are many logical and political controversies on regard of this issue, as cloning prohibition is supported by a great amount of people from all over the world and could provide a protection against further ethical standards destruction within the area of medical research. If society cannot withstand this kind of research attraction, when the benefits are not obvious enough and world community is against it, it is difficult to suppose what it would withstand in the future.

Research Paper on Corporate Ethics

Corporate Ethics at Wal-Mart

At the begging, the corporations on the United States were blamed for lack of business ethics and failing to exercise appropriate control over their executives. After the bursting of the “dot-com bubble” an ethical crisis spread not only nationwide but globally as well. Nowadays most of the companies have significantly improved in fighting their shortcomings, ethical and compliance officers are assigned, new procedures for controlling improper conduct are implemented, managerial personnel takes part in ongoing ethical training programs in order to make them aware of the corporate social responsibility. The big business adjusts to the legal environment very quick due to the heavy monetary penalties, criminal prosecutions and long time jail sentences, whereas on the past the corporations were very reluctant to cooperate with the authorities, resisting regulatory and judicial investigation and providing legal protections for their top managers.

As the world’s largest retailer and N1 in Fortune 500, Wal-Mart has always been in the spot light. Along with its foundation in 1962, Sam Walton established the three basic believes which are the driver of his successful business:

Respect for the individual
Service to our customer
Strive for excellence

In addition to that Sam Walton stipulated in the Statement of Ethics as essential the following guiding ethical principles:

Follow the law at all times;
Be honest and fair;
Never manipulate, misrepresent, abuse or conceal information;
Avoid conflicts of interest between work and personal affairs;
Never discriminate against anyone;
Never act unethically - even if someone else instructs you to do so;
Never ask someone to act unethically;
Seek assistance if you have questions about this Statement of Ethics or if you face an
ethical dilemma;
Cooperate with any investigation of a possible ethics violation; and
Report ethics violations or suspected violations.

Wal-Mart is very often listed by Fortune magazine as one of US most admired companies but at the same time the corporation faces criticism about its employment practices and it is frequently subject to litigation. The Markkula Center for Applied Ethics poses the question: “Is it Ethical to Shop at Wal-Mart?” Bob Brownstein sees a big mismatch between the company Statement of Ethics and the reality. He takes four basic points to illustrate the environment at Wal-Mart:

1. Basic standard of living – the average annual income of the employees is around $13,312 which is below the Federal poverty level for a family of three (which is $14,630). 2/3 of the employees can’t afford to take part in Wal-Mart’s health insurance plan. It amounts to 20% of their paycheck
2. Inequality – huge amount or worker trapped in a low pay dead-end service job without benefits
3. Increased material and technological innovation and productivity – Wal-Mart sells cheaper taking away business of already existing firms
4. Non-Market institutions – Wal-Mart is an economic force which transform people into anomic creatures driven by the search of bargains.

Opinions like that are not few but the largest retailer faces not only criticism but many lawsuits the biggest one of which is 11-billion dollar class-action discrimination lawsuit, employee pay and health benefits. Legislators changed regulations for big companies regarding healthcare plan of the workers. In 2006 Wal-Mart launched a huge PR-campaign to oppose the critics and the show the positive impact the company has on the working families. But hiring a global ethics officer was not only a defensive act, moreover it was an attempt to present itself in front of the critics as a reputable employer with spotless image at home and abroad. But is it like this in fact? Couple of yeas ago, in 2006, former Wal-Mart executive Tom Coughlin, got convicted for not complying with the Foreign Corrupt Practices Act. It requires full accounting transparency under the Security and Exchange Act. The former vice-chairman of the board of directors pled guilty for defrauding the company and tax evasion. The verdict of the judge was 27-month home confinement.

The common practices of Wal-Mart attract the attention of not only the labor unions and authorities but also the nature activists. There are many case of environmental abuse. The states of Pennsylvania, Connecticut and Washington are very upset with the retailer for violating the state water quality regulations. Wal-Mart was accused for not complying with standards for construction site cleaning. After heavy rains the water was bringing tons of silt in the nearby rivers, endangering the fish and the drinking water for thousands of people. In 1998 Pennsylvania's Department of Environmental Protection ordered the construction to be halted. At that time the store construction was almost over. Wal-Mart was also accused for another destructive business policy. This time the problem comes from the placement of the stores. Most of the retail shops are built on a farmland. The environmental activists are posing the question: “why do the counties and municipality allow construction of stores on huge farmland, when there is a global shortage of food supply?” Apparently they believe these farmlands could provide sustenance for more people. But this is not the only negative side of the Wal-Mart stores locations. This problem is referred to as the “urban-sprawl” issue and it continues to grow. It increases the car-dependency for the communities, raising the amount of greenhouse gases emitted and therefore the usage of more gas. Wal-Mart faced many other claims from different State environment agencies (Connecticut, Texas, Illinois) and even the Federal Environment Protection Agency. Even though they undertook a huge campaign to show to the people and authorities how environmentally friendly they are, a simple calculation made it clear that Wal-Mart cause more harm to the nature that it preserve it. A donation amounting to $190 million was given away for charity, with $1.3 million was made for nature friendly causes. It looks a huge number but this 0.021% from the profit that goes to help the environment.

As the biggest retailer and second largest employer (after the Federal government) Wal-Mart is huge economic force and the labor, legal and environmental problems associated with it, are huge.
